immortalize MKO

Democracy day speech had a lot of matters voiced out, and has had a lot of commentaries from both adult and children, olodo n literate. well, this is mine. first of all who has, or is very RESPONSIBLE for the welfare, appointment, retirement and other things of all federal institutions nation-wide? by federal institution i mean F.G universities, F.G colleges and those other matters. I think the answer is the federal government. okay, okay okay lets look at things from another light, who, or what body pays federal government staff? no lie, and no time for dilly-dally, its the federal government. now since that 1 is concluded, and answer agreed upon, what then is the problem with the protesting children(students)? i mean do i not have the right to christian or re-christian my thing? inLaw it goes 'nemo dat quod non habet' you do not give what you do not have, now Mr Jonathan has the constitutional mandate to over-see the affairs of the Government in a Federal level, and the Boss used his office to immortalize chief MKO Abiola. please reader how else can you have the life and times of a great man remembered? this man did not bring democracy into Nigeria, he however had the guts or courage or mind or morale or lamba to face and challenge the federal government ran by a military senior-man;and not only challenged IBB, MKO even declared himself presido.(dats highest liver)

should Mr Jona use National stadium to immortalize MKO, or should he use GSS Garki or GSS Tudun-wada?(THEwriter's prestigious sec schools).... look just for the records, university of ile-ife which was established in 1961(before Uni-lag) was transformed to Obafemi Awolowo University in 1987 after he(Awolowo) died. now everybody de piss-off cos Uni-Lag has been changed to MAU-Lag on a day where democracy is to be held highest in Nigeria. look Murtala Muhammed international airport was named by OBJ one year like dis, but the effect of an airport cannot be compared with that of an institution of that calibre, because if i dont leave or arrive Eko i might never hear of the man(murtala) unlike an institution where thousands go in and out of. it might interest you to know that not all the MAU-LAG graduates since its establishment have used that airport, maybe many, but definately not all.

immortalizing a man entails ensuring his name, life and achivement live-on for eternity, that has been achieved in naming him after an institution of that repute. i must say that 'name' does not affect out-come of student, or input their many professors have to offer. look point remains that no matter what man does people will talk. Abiola lost his wife(kudirat) and his life too, and all of these deaths must be traced to his battle, fight for democracy. (isnt that what we all advocate?)

imagine that IBB had handed over to Abiola in 1993? many many many correct stuff would have happened to strengthen democracy... abi? well, dats gist for another day. now they say its wrong timing, timing is immaterial cos this honour is due to this great Nigerian Adult, and the day it was said is perfectly perfect, 'DEMOCRACY DAY'   i think its not in every ocassion people should open their gutter and talk, its pertinent to note that we shouldnt comment on all matters as we are not authorities in all gamuts of life, arguements like this and other very sensitive ones should be allowed to be discussed by Men Only.

people just de vex cos from UNILAG to MAU in seconds, lmao, its painful sha, just reason say u de 500 level and you know ur certificate will not carry UNILAG; LMFAO... regardless we have to realize that certain decisions might not favor us in its entirety, but if it has even an element of 'everybody' we should just lock-up, embrace it and not result to un-neccessary violence.

if your Father is MKO would you not welcome the idea? answer in your mind....
FYI MAU is Madonna University, make una find another name answer....

thank you.

  1. Brother Poker, let's not dilly dally as you said. No one said he did wrong in immortalising MKO Abiola. The only wrong people saw was in the choice of UniLag for such immortalisation.

Yes! The President's has got the right to renamne the UniLag, but as a law graduate, I believe you know about exercising powers and rights discretionarily and not arbitrarily. One of such laid down modes in which the President could've exercised such right discretionarily is in consulting and ultimately having the mind and approval of the University Council before embarking upon such act; But here, he surprised everyone (UniLag Council inclusive) by his Democracy morning broadcast - just like January 1st Removal of Oil Subsidy broadcast.

Again, I understand pretty well that you, as a Jurispudential scholar is well seised of the knowledge of "Legal Personality"? Good! UniLag which I noticed is about 50years now has attained such height in being a legal person that her change in nomenclature should not be performed anyhow. And not just that, I align with my learned senior, Sagay, who suggested that there were nine new University created by FG. Any of them could have been entitled such name.

So, I do not see anything wrong or improper in what UniLag's students are protesting. They were not intimated of this development before hand - an implication that the University's Council was not sought.

Finally, you Poker, if by around your 50th year in life and any of your parent still alive comes up suprisingly and without your knowledge decides to change your name, how'd you feel? So, let's get the gist well brother; We're not against the President's intention of immortalising Abiola. The choice of UniLag and the mode of undertaking such renaming is what we reckon as simply wrong or improper.

    1. Counsel, I think it boils down to double standard of man - two faces.
If a man is worthy of praise, praise him. What is about UniLag that her title cannot be changed? I always thought it's the student, not the school; the lawyer, not the law office, the doctor, not the hospital.

  2. CORRIGENDUM:

In my second paragraph of my earlier comment to this post, I erroneously stated that the President has powers to rename UniLag. I think I'm wrong.

After much research, I discovered that the President do not actually have powers to rename UniLag, either by Presidential fiat, veto or constitutionally.

    UniLag is a creation of statute. Its name is given it by University of Lagos Act of 1962 as amended and currently University of Lagos Act, Cap U9, LFN 2004. Section 1 of the Act provides as follows;
"• There is hereby established a University to be known as the University of Lagos (in this Act referred to as “the University”) to provide courses of instruction and learning in the faculties of Arts, Law, Medicine, Science, Education, Commerce and Business Administration, Engineering, and any other faculties which may, from time to time, be approved under this Act.
•The University shall be a body corporate and shall have perpetual succession and a common seal."
It follows therefore, that the above reproduced section of the Law without equivocation states that the name of the University is ‘University of Lagos’.
This amply demonstrates that the name ‘University of Lagos’ is derived from an Act of the National Assembly.
Any other name other than ‘University of Lagos’ would run contrary to the provisions of the Act. In other words, that announced by the President on Democracy day is unknown to the University of Lagos Act.

Again, to buttress my point that the President lacks power to rename UniLag, the Act confers upon him certain powers as the Visitor to the University. By virtue of Section 16 of the Act, such powers are limited and does not include renaming the University. They do not empower him to unilaterally direct or effect a change in the name of the University. And where he does so, he'll only be acting ultra vires because it is trite, as the principle of ultra vires states, that where power is vested in any individual or body, such body or individual cannot exceed the powers which had been so vested. To do so would be to go beyond the confines of such vested powers, hence acting ultra vires.

Assuming, but not conceding to the fact, that he is acting under his capacity as the President, and not Visitor, he's equally wrong to cause the name of the Institution to be so renamed by pronouncement. UniLag being a creation of statute can only be renamed through an amendment by another Act of National Assembly. So, the President's decision ostensibly acting in concert with the Federal Executive Council amounts to an usurpation of the powers of the National Assembly.  Constitutionally, he's wrong. For the 1999 Constitution as amended(Under Section 4) confers legislative powers of the Federal Republic of Nigeria upon the National Assembly which comprises the Senate and the House of Representatives.

This is my constructive way of saying that the President in all manner of speech and deed, acted wrongly, especially in a democratic setting like ours.
